Jurista estadounidense. Nacido en una distinguida familia judía, fue admitido a la asociación de abogados de Nueva York y se convirtió en un abogado de tribunales de gran éxito. Fue elegido para integrar la Corte Suprema del estado como candidato de la reforma (1913), y fue rápidamente promovido a la Corte de Apelaciones. Durante el tiempo que desempeñó el cargo, muchos pensaban que la calidad de dicho tribunal era superior a la de la Corte Suprema. Influyó en la tendencia de la Corte de Apelaciones a un mayor involucramiento en las políticas públicas y la consiguiente modernización de los principios jurídicos. Era tanto un creativo juez del
common law como un notable ensayista legal. Nombrado para la Corte Suprema de los
Estados Unidos de América en 1932, habitualmente votaba junto a los liberales Louis Brandeis y Harlan Fiske Stone. Redactó el voto de mayoría afirmando la constitucionalidad de la ley de
seguridad social (1937). En una causa de 1937 sobre el principio de
cosa juzgada, sostuvo que los estados no estaban obligados a poner en práctica todas las disposiciones del Bill of Rights, una posición que se hizo conocida como "incorporación selectiva Se desempeñó en la Corte Suprema hasta 1938. La escuela de derecho de la Universidad de
